Terms of personal data protection
I. Introductory Provisions
For the purposes of these Principles, the following is understood:

Personal data includes name and surname, residential address, email address, phone number, business identification number, and tax identification number of the individual entrepreneur.
The Operator, as the controller of personal data, hereby informs about the method and scope of processing personal data, including the rights of the User (as defined below) related to the processing of their personal data.
The Operator acts as a consultant in the field of personal data protection and, for this purpose, operates the information website www.gdpr.cz, which includes a Documents section. In the framework of this service, personal data is processed by the Operator:
to the extent provided in connection with the order of the Operator's products and/or services, respectively in the course of negotiations on the conclusion of a contract with the Operator, as well as in connection with the concluded contract; and
for the purposes/objectives listed below in section 4.
The Operator processes personal data for the following purposes:
fulfilling the contract and providing services;
fulfilling legal obligations (especially accounting, tax, and archiving);
marketing and commercial offers of the Operator's services;
protecting the rights and legitimate interests of the controller (legitimate interest).
The Operator is the controller of personal data. Personal data is not processed by any other entity. Only the controller will have access to processed personal data.
II. Personal Data Protection and Information on Processing
The law no. 101/2000 Coll., on the protection of personal data, as amended, and other relevant legal regulations apply to individuals who fill out and send the completed order form to the Operator from the www.gdpr.cz information website (hereinafter referred to as "User").
The User acknowledges that by submitting the completed order form, the processing of personal data by the Operator begins.
If the User does not provide their personal data, it is not possible to conclude a contract with the Operator and/or provide them with the services resulting from it. Personal data is necessary in this context for the provision of a specific service or product of the Operator.
Personal data will be processed during the negotiation period for the conclusion of a contract between the Operator and the User, and for the purpose of concluding the contract, as well as for the duration of the contractual relationship.
In the event of a contract concluded under the Operator's Terms and Conditions, personal data will be processed and stored for the following 36 months in case of disputes concerning the relationship between the Operator and the User, for the purpose of protecting the Operator's legitimate interests. The Operator's legitimate interest is the proper and timely fulfillment of the agreed contractual obligation between the Operator and the User and the fulfillment of legal obligations arising from the contractual relationship between them.
For the purpose of fulfilling the statutory obligation to archive accounting documents under Act No. 563/1991 Coll., on Accounting, as amended, personal data (excluding email address and phone number) will be processed and stored for 5 years, starting from the year following the year in which the contract was concluded between the Operator and the User.
Personal data – phone number and email – will be processed for marketing and commercial communication purposes for the duration of the User's registration under Article II, paragraph 5, and for 12 months thereafter, unless consent is revoked by the User at any time.
After the expiration of the periods specified in Article II, paragraphs 4, 5, 6, and 7, the Operator will destroy the personal data.
The User is obliged to provide the Operator with only truthful and accurate personal data.
The Operator will make maximum efforts to prevent unauthorized processing of personal data.
User's personal data will not be transferred to any third parties, third countries, or international organizations.
Personal data is and will be processed electronically in a non-automated way.
The User acknowledges that their personal data is stored in data centers of Google LLC. The Operator uses G Suite and Google Cloud Platform services, which comply with European data protection standards.
The User acknowledges that Google LLC cookies may be stored on their device.
III. User Rights Related to Processing
The User has the right to withdraw their consent (in cases where personal data processing is based on consent) at any time. Withdrawal of consent for the processing of personal data is not possible to the extent and for the purposes of fulfilling the Operator's legal obligations. Withdrawal of consent does not affect the legality of processing based on consent given before its withdrawal. Withdrawal of consent also does not affect the processing of personal data that the controller processes on another legal basis than consent (i.e., especially if processing is necessary to fulfill a contract, legal obligation, or for other reasons provided for by applicable legislation).
The User also has the right to:
request access to their personal data from the Operator;
request correction of provided personal data;
request deletion of provided personal data;
request restriction of personal data processing; and
file a complaint with the Office for Personal Data Protection.
If the User believes that the Operator is processing their personal data in violation of their private and personal life or in violation of applicable legal regulations, especially if personal data is inaccurate concerning the purpose of its processing, they may:
request an explanation from the Operator via email at office@gdpr.cz;
object to processing and request that the Operator ensures the elimination of such state (e.g., blocking, correction, supplementation, or destruction of personal data) by sending an email to office@gdpr.cz. The Operator will promptly decide on the objection and inform the User. If the Operator does not comply with the objection, the User has the right to contact the Office for Personal Data Protection directly. This provision does not affect the User's right to contact the Office for Personal Data Protection directly with their complaint.
If the User requests information about the scope or method of processing their personal data, the Operator is obliged to provide this information promptly, but no later than one month from the receipt of the request at office@gdpr.cz.
If the User exercises the right of access to personal data electronically, the Operator will provide the required information also in electronic form, unless the User requests a different method of providing the information.
The Operator is entitled to charge a reasonable fee for administrative costs associated with the provision of a physical copy of processed personal data in the case of repeated and unfounded requests.
IV. Final Provisions
All legal relationships arising in connection with the processing of personal data are governed by the legal order of the Czech Republic, regardless of where access to them was made. Any disputes arising in connection with privacy protection between the User and the Operator are subject to the jurisdiction of Czech courts.
Users who provide their personal data via the order form for the purpose of concluding a contract with the Operator or give consent to the processing of personal data do so voluntarily, in their name, and the Operator does not direct their actions in any way.
The Operator may change or supplement the text of the Principles. The Operator will inform Users of any such changes via email at least 30 days before the changes take effect.
These Principles are effective as of 01.01.2020.
